Privacy Policy

I. Purpose

Quiddity values its users’ privacy. The purpose of this Privacy Policy is to inform you as to the information Quiddity collects, the way Quiddity uses information, and how Quiddity may disclose that information. This Privacy Policy is part of Quiddity’s Terms of Use Agreement, and incorporated into that Agreement. By visiting Quiddity.com you are accepting the practices described in this Privacy Policy.

 

II. Information Use, Collection, and Disclosure

Information Collected by Quiddity: The information we learn from customers helps us personalize and continually improve your shopping experience at Quiddity.com. Most of the information that we collect is that information which you give us. We receive and store any information you enter on our Web site or give us in any other way. Examples include your contact information like your name, address, email address, and phone number. Additionally, you will provide us with your certain financial information on the Web site, through PayPal or your merchant account. We may also collect transactional information based on your activities in the site, such as what types of items you have browsed or purchased and how much you have spent in a certain period of time. We may also collect shipping, billing, and other information you provide to purchase or ship an item. Finally we may collect other supplemental information from third parties (for example, if you incur a debt to Quiddity, we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law; or if the information you provide cannot be verified, we may ask you to send us additional information, such as your driver license, credit card statement, or a recent utility bill or other information confirming your address, or to answer additional questions online to help verify your information). You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. Quiddity and Quiddity.com do not use “cookies” or any other tracking software on users’ computers.

Use of Information by Quiddity: Information supplied by you to Quiddity, which is personally identifiable information, is used by Quiddity to serve you and operate and maintain Quiddity services. We use the information that you provide for such purposes as responding to your requests, customizing future shopping for you, improving our stores and Web page, and communicating with you. Quiddity does not use personally identifiable information, without your consent, for any commercial or marketing purpose. Quiddity may use your email address or IP information, without your consent, for non-commercial, non-marketing, and administrative purposes throughout the time you use Quiddity’s services.

Disclosure of Information by Quiddity: While we may receive information about you from other sources and add it to our account information, Quiddity, Quiddity.com and its affiliates will not sell or provide any user information to third parties. Information about our customers is an important part of our business, and we are not in the business of selling it to others. However, Quiddity reserves the right to disclose personally identifiable information that Quiddity believes is necessary or appropriate to enforce Quiddity’s rights or enforce this Agreement. This disclosure of information may be used to investigate or defend against any allegations or claims against Quiddity or involving Quiddity’s services, to assist government enforcement agencies, and to protect the property rights and safety of Quiddity and its users or other individuals. Quiddity may release information if required to do so by law, or in good faith that such disclosure is necessary to comply with any state law, federal law, or local law enforcement agency. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in this Privacy Policy.

 

III. Pledge to Security

Quiddity aims to use appropriate and commercially reasonably safeguards to protect the security of personal information and personally identifiable information. However, Quiddity has limited control and cannot warrant complete security of information that is posted or transmitted through Quiddity’s services. Therefore, your posting or transmitting of personal information is done at your own risk. If there is a serious breach in the security of Quiddity’s services, then Quiddity will attempt to contact you as to this breach, and allow you to take further steps necessary to protect your information.

 

IV. International Use

Quiddity’s services are hosted in the United States and are for the use of users in the United States. However, if you use and access Quiddity’s website or services from outside of the United States, then be aware that United States laws apply to Quiddity and its services, as opposed to any foreign or regional law which may concern intellectual property rights, privacy rights, or other personal rights, and collection of data.

 

V. Policy Regarding Children

Quiddity does not knowingly collect or maintain personally or other identifiable information on Quiddity.com or through Quiddity services from persons under thirteen years of age, and no part of our services or website is directed to persons under thirteen years of age. If Quiddity learns that personally identifiable information of persons under thirteen years of age has been collected on Quiddity.com or through Quiddity services without verified parental consent, then Quiddity will take the appropriate steps to delete this information. Quiddity does not sell products for purchase by children. If you are under 18, you may use Quiddity.com only with the involvement of a parent or guardian.

 

VI. Merger, Sale, Bankruptcy, or Other Event

As we continue to develop our business, we might sell or buy stores, subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless the customer consents otherwise). If Quiddity is acquired by or merged with any other entity, we maintain and reserve the right to assign or transfer any information that Quiddity has collected from users. In the event of Quiddity’s bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights, your information may be transferred or disclosed.

 

VII. Updates and Changes to Privacy Policy

As with the Agreement concerning the terms of use of Quiddity’s services, this Privacy Policy may be altered or modified at any time, and from time to time without any prior notice. It is up to you to maintain awareness of Quiddity’s Privacy Policy, and your use and continued use of Quiddity’s services constitutes your assent to the terms of this Privacy Policy and future changes or modifications thereto. We stand behind the promises we make and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers. If you choose to visit Quiddity.com, your visit and any dispute over privacy is subject to this Policy and our Terms of Use, including limitations on damages, arbitration of disputes, and application of the laws of the state of Oregon.
